A judge proceeding over the Daniel Penny case dismissed manslaughter charges against Penny who took the life of a homeless man with mental illness.
In 2023, Daniel Penny, 24, White, put Jordan Neely, a 30-year-old Black man, in a 6-minute fatal chokehold on a Subway in New York while two other White men restrained him and watched. Neely was said to be "disturbing others" but did not have a weapon nor did he hit anyone.
Neely died on the scene and his death was ruled a homicide by the city's medical examiner. Penny is free on a $100,000 bond and the judge asked the jurors to deliberate on lesser charges.
RIP to Jordan Neely and our condolences to his family.
